REFUND & CANCELLATION POLICY

This Refund & Cancellation Policy applies to all payments made to Afsuham for consulting, advisory, strategy, business development, market-entry, transaction support, research, project-based work, and any other professional services.
This Policy is intended to comply with applicable consumer protection laws in the United States and the European Union, including principles of transparency, fairness, and clarity regarding digital and professional services.
1. General Refund Policy
All fees paid to Afsuham are final and non-refundable, except where a refund is required under applicable law or expressly agreed in writing by Afsuham prior to payment.
Once payment has been made for any service (including retainers, advisory fees, consultation fees, project fees, or similar professional charges), no refund will be issued solely because the client:
- changes their mind or no longer wishes to proceed;
- delays, suspends, or terminates the engagement;
- modifies project requirements or scope; or
- does not use or implement the delivered advice or services.
This policy reflects that professional services involve immediate allocation of time, expertise, planning, and resources upon engagement.
Nothing in this section limits any mandatory statutory rights that may apply under EU or US law.
2. Commencement of Services
Services are considered commenced once Afsuham begins any work related to the engagement, including but not limited to:
- reviewing client materials or documentation;
- conducting research, analysis, or internal assessments;
- allocating personnel, consultants, or partners;
- scheduling meetings, workshops, or consultations;
- preparing reports, strategies, presentations, or recommendations;
- engaging with third parties on behalf of the client; or
- any preparatory or execution-related professional activity.
Once services have commenced, fees are considered earned to the extent permitted by applicable law.
3. Right of Withdrawal (EU Consumers)
If you are a consumer located in the European Union and the service is purchased remotely (online or otherwise at a distance), you may have a 14-day right of withdrawal under EU consumer law.
However, you acknowledge and agree that:
- If you request that services begin during the withdrawal period, you expressly consent to immediate performance; and
- You acknowledge that you may lose your right of withdrawal once the service has been fully performed.
Where services have been partially performed, you may be required to pay for the proportion of services already provided up to the point of withdrawal, in accordance with EU law.
4. Cancellation by the Client
Clients may request cancellation of an engagement by providing written notice.
Cancellation does not automatically entitle the client to a refund of amounts already paid.
Where payment obligations are structured in instalments or milestones, all outstanding amounts remain payable unless otherwise agreed in writing.
Any cancellation rights under applicable law remain unaffected.
5. Rescheduling of Services
Where services include scheduled meetings, consultations, or workshops, reasonable rescheduling may be permitted at Afsuham’s discretion, subject to availability and prior notice.
Rescheduling does not constitute cancellation and does not entitle the client to a refund.
Repeated cancellations or failure to attend may result in the session being deemed delivered.
6. Client Responsibilities and Delays
Clients are responsible for providing timely and accurate information required for service delivery.
No refunds will be issued where delays or inability to perform services arise due to:
- failure to provide required information or access;
- delayed responses or approvals;
- changes in scope or direction;
- missed meetings or lack of participation; or
- any other client-related obstruction.
7. Changes in Scope
Any material change in scope may require revised pricing, additional fees, or a new agreement.
Payments already made are not automatically transferable to materially different services unless expressly agreed in writing.
8. No Guarantee of Outcomes
Afsuham provides professional advisory and consulting services based on expertise and available information.
Unless expressly guaranteed in a written agreement, Afsuham does not guarantee:
- financial or commercial results;
- investment returns or valuations;
- regulatory approvals;
- transaction completion;
- fundraising success; or
- any specific business outcome.
Failure to achieve a desired result does not entitle the client to a refund.
9. Third-Party Involvement
Some services may depend on third parties such as investors, regulators, financial institutions, or business partners.
Afsuham is not responsible for decisions, delays, or outcomes caused by third parties.
Such outcomes do not constitute grounds for a refund.
10. Statutory Rights (US & EU Compliance)
Nothing in this Policy excludes, limits, or modifies any rights you may have under applicable consumer protection laws in your jurisdiction, including:
- EU Consumer Rights Directive (2011/83/EU), where applicable;
- national consumer protection laws in EU Member States;
- applicable US federal or state consumer protection laws.
Where a conflict exists between this Policy and mandatory law, the applicable law will prevail.
11. Duplicate or Incorrect Payments
If you believe a payment has been processed incorrectly, including duplicate charges or technical errors, you should contact Afsuham promptly.
Verified errors will be corrected or refunded where applicable.
12. Chargebacks and Payment Disputes
Clients are encouraged to contact Afsuham before initiating any chargeback or payment dispute.
Unjustified chargebacks for valid services may be treated as a breach of payment obligations and handled in accordance with applicable law and contractual terms.
13. Separate Agreements
Where a signed agreement, proposal, invoice, or statement of work contains specific refund, termination, or cancellation terms, those terms will prevail over this Policy to the extent permitted by law.
14. Acceptance of Policy
By making a payment to Afsuham, you confirm that you have read, understood, and agreed to this Refund & Cancellation Policy, together with any applicable service agreement or engagement terms.
